The federal standard behind baby sleepwear labels explained: the snug-fit path, inherently FR fibers like wool, and what the 'for play' label actually means.

What the law actually requires

The federal standard for children's sleepwear is 16 CFR Parts 1615 and 1616, administered by the Consumer Product Safety Commission (CPSC). Part 1615 covers children's sleepwear sized above 9 months through size 6X. Part 1616 covers sizes 7 through 14. Both parts apply to any garment labeled or marketed as sleepwear and intended to be worn primarily for sleeping.

The regulation dates to 1971. In 1996, the CPSC added a second compliance path: the tight-fitting garment exemption.

Two ways a garment can comply

A children's sleepwear garment reaches shelves through one of two routes.

Path 1: Tight-fitting construction

The garment must meet dimensional specifications written into the regulation. The specs define maximum stretch values and maximum dimensions for each garment piece (chest, waist, sleeve, and so on) relative to the labeled size. A garment meeting those dimensions does not need to pass a fabric burn test. The underlying finding from the 1996 rulemaking was that a snug garment lying against the skin does not catch and sustain a flame the way a loose garment does, because fit eliminates the air gap that feeds combustion.

Garments compliant under this path must carry the label "snug-fitting: not flame resistant." The label communicates three things:

  • The garment has not been chemically treated.
  • It has not been tested to the fabric burn standard.
  • Compliance depends entirely on fit. The protection is lost if the garment is worn too large.

Path 2: Flame-resistant fabric

The fabric (or finished garment) must pass a burn test specified in 16 CFR 1615.4 and 1616.3. A 10-inch fabric specimen is exposed to an open flame for three seconds. The char length must not exceed 7 inches, and the specimen must not continue burning for more than 10 seconds after the flame is removed. Both conditions must be met.

Path 2 has two routes to reaching that standard.

Route A: Inherently flame-resistant fibers

Some fibers resist ignition because of their chemical structure, not because of a surface treatment. Wool is the most important example for children's sleepwear.

Wool has a naturally high nitrogen and moisture content. Its ignition temperature is approximately 570 to 600°C, compared to roughly 255°C for cotton. When exposed to a flame, wool chars rather than burns, self-extinguishes when the ignition source is removed, and does not melt or drip. It also requires an oxygen concentration above 25% to sustain combustion; normal air is approximately 21% oxygen. These properties allow wool to pass the Part 1615/1616 char-length test without chemical treatment and without the snug-fit dimensional restrictions of path 1. A full-cut, loose-fitting merino wool footed pajama can be sold as compliant sleepwear because the fiber itself meets the standard.

Other inherently flame-resistant fibers include modacrylic (a synthetic acrylic-based fiber often blended with cotton) and Lenzing FR (a modified cellulose fiber). In each case, the fire resistance is built into the polymer or fiber structure, not applied as a finish.

Route B: Chemical flame-retardant treatment

Fabric that would not pass the burn test in its natural state can be treated to pass it. Loose-cut cotton flannel pajamas are the standard example.

Cotton ignites readily, burns without self-extinguishing, and does not char in a way that stops flame spread. To sell a loose-fitting flannel pajama as sleepwear, the manufacturer must either treat the fabric before construction or treat the finished garment afterward. Common durable treatments include:

  • Proban: a phosphoric acid amide chemistry applied to cotton, durable through 50 or more launderings.
  • Pyrovatex: an organophosphate ester chemistry with similar durability.

Both treatments survive the repeated laundering tests required under the standard. Neither is required to appear on the consumer label. A parent buying a loose-cut flannel pajama with a sleepwear label knows the fabric has been treated; the label does not say which treatment was used or at what residual level.

Why loose-cut cotton flannel cannot skip treatment

The physics are simple. A loose garment creates an air gap between fabric and skin. That gap supplies oxygen to a flame and allows it to spread and sustain itself. Even if two fabrics share the same ignition temperature, the loose garment in an air-gap configuration will burn longer and more intensely than a snug garment of the same material.

Cotton flannel adds a second factor: its napped surface increases the fabric's surface area and accelerates flame propagation. A tightly woven cotton duck or canvas would behave differently, but the CPSC standard does not distinguish weave structure. Any loose-fitting cotton garment marketed as sleepwear must pass the char-length test.

The tight-fitting exemption removes the need for chemical treatment on snug garments for exactly this reason: fit does the work the chemistry would otherwise do.

The "for play, not sleepwear" label

The 1996 rulemaking that added the tight-fitting exemption also created a third category of children's nightwear: garments that look like pajamas but are not classified as sleepwear under the regulation.

A garment labeled "for play, not sleepwear" or "not intended for use as sleepwear" is not subject to 16 CFR Parts 1615 or 1616. The manufacturer is representing that the garment is not sleepwear, so neither the burn test nor the snug-fit specifications apply.

What the label does not mean: it is not a product-safety warning. It is a regulatory classification. A loose-cut merino wool pajama could carry this label if the manufacturer chose not to certify under Part 1615 or 1616, even though the fiber would pass the char-length test. The label describes the regulatory classification, not the fabric's fire behavior.

What the label typically means in practice: on a loose-cut cotton garment, "for play, not sleepwear" almost always means the fabric is untreated and has not been tested to the char-length standard. The regulation was specifically designed to prevent children from sleeping in loose, untreated cotton. The "for play" label is the mechanism that lets manufacturers sell such garments legally while disclaiming the sleepwear classification.

Some families choose loose untreated cotton garments deliberately to avoid chemical flame-retardant treatment. That trade-off is real: the compliance path for loose cotton is chemical treatment, which carries its own skin-contact questions the CPSC standard does not answer. The regulation does not resolve this. It defines two compliant pathways and leaves the "for play" market as both a manufacturer exit and a consumer choice.
