Terms of Service

These Terms of Service ("Terms") govern your access to and use of nontoxicnook.com (the "Site") operated by nontoxicnook ("we," "us," "our"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.
Important — please read carefully. These Terms contain a disclaimer of warranties (Section 8), a limitation of our liability (Section 9), an indemnification obligation (Section 10), and a binding dispute-resolution clause with an individual-action requirement (Section 13). They limit your rights, including your right to bring legal action.
1. Eligibility
The Site is intended for users who are 16 years of age or older. By using the Site you represent and warrant that you meet this age requirement, have the legal capacity to enter into these Terms, and are not barred from using the Site under any applicable law.
2. What the Site is — and isn't
nontoxicnook is an independent editorial publication and buyer's guide about non-toxic home and baby products. It is not a retailer, distributor, manufacturer, or agent of any product listed. We do not sell, stock, ship, or fulfill products. Every "Buy on …" or similar link directs you to a third-party brand or retailer where any transaction takes place under that merchant's terms. We are not a party to your transaction with any merchant.
Editorial content is informational and reflects our own research and opinions. It is not a substitute for personalized medical, legal, financial, or other professional advice. See the Disclaimer for the full set of caveats.
3. Accounts
Some features require an account. When you create an account you agree to:
- Provide accurate, current, and complete registration information.
- Maintain and promptly update your account information.
- Keep your password confidential and not share it with any third party.
- Be responsible for all activity that occurs under your account.
- Notify us immediately at hello@nontoxicnook.com if you suspect any unauthorized use of your account.
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms or applicable law. You may delete your account at any time from the account settings page or by emailing us.
4. Acceptable use
You agree not to, and not to attempt to:
- Use the Site for any unlawful, fraudulent, harmful, harassing, defamatory, or infringing purpose.
- Access non-public areas of the Site, server infrastructure, or administrative interfaces.
- Probe, scan, or test the vulnerability of the Site, or breach or circumvent any security or authentication measures.
- Interfere with or disrupt the Site, the servers or networks supporting it, or any other user's enjoyment of it (including by introducing malware, conducting denial-of-service attacks, or sending automated requests outside our published API limits).
- Reverse engineer, decompile, or otherwise attempt to derive source code or underlying algorithms of the Site, except to the extent applicable law prohibits this restriction.
- Use any automated means (scrapers, bots, crawlers other than search engines acting in compliance with our
robots.txt) to extract content or data from the Site. - Use, copy, frame, mirror, or republish substantial portions of the Site's content without our prior written permission, except for normal Internet linking and as expressly permitted by Section 5.
- Misrepresent your affiliation with a person, brand, or entity, or impersonate any person.
- Use the Site to send unsolicited commercial messages or to collect information about other users.
- Manipulate affiliate tracking, including by inserting your own affiliate identifiers, generating clicks you know to be invalid, or otherwise interfering with our or our affiliate networks' attribution systems.
We may, but are not obligated to, monitor use of the Site for compliance.
5. Intellectual property
The Site and all of its content — including text, articles, product write-ups, reviews, methodology, photographs, illustrations, graphics, logos, the nontoxicnook name, the look and feel of the Site, and the underlying software — are owned by us or our licensors and are protected by copyright, trademark, trade dress, and other intellectual-property laws of the United States and other jurisdictions.
You are granted a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site solely for your personal, non-commercial use, subject to these Terms. No other rights are granted, by implication, estoppel, or otherwise. All rights not expressly granted are reserved.
You may share short excerpts with attribution and a link back to the source article (for example, on social media or in a personal blog). Any other republication, redistribution, scraping, training of machine-learning models, or commercial reuse requires our prior written permission.
6. User-submitted content
If you submit content to the Site — for example through the contact form, an email, or in any future user-facing feature — you grant nontoxicnook a worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable license to use, copy, store, modify, display, distribute, and create derivative works of that submission for the purpose of operating, improving, and promoting the Site. You represent and warrant that you own or have all necessary rights to grant this license, that your submission is accurate and not misleading, and that it does not infringe any third-party right or violate any law.
You are solely responsible for your submissions. We may, but are not obligated to, review, edit, or remove any submission at any time for any reason without notice.
7. Affiliate links
The Site contains affiliate links. We may earn a commission when you click an outbound link and complete a qualifying purchase at the destination merchant, at no additional cost to you. Any transaction you enter into with a third-party merchant is between you and that merchant. nontoxicnook is not a party to and not responsible for the merchant's product information, pricing, availability, fulfillment, returns, refunds, warranties, customer service, or any other aspect of the transaction.
8. Disclaimers — no warranties
The Site, its content, and any associated services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, nontoxicnook disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement, and any warranties arising from a course of dealing, course of performance, or usage of trade.
Without limiting the foregoing:
- We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components.
- We do not warrant that any information on the Site is complete, accurate, current, or reliable.
- Product formulations, ingredients, prices, availability, certifications, and merchant terms change frequently and outside our control. We make a good-faith effort to verify and refresh listings but cannot guarantee that any specific listing is current at the moment you view it.
- Editorial content is the author's opinion, not medical, legal, financial, safety, or other professional advice. See the Disclaimer.
- Nothing on the Site is a guarantee that any product is safe, suitable, or appropriate for you or any specific person, condition, or use case.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, in no event will nontoxicnook, its operators, officers, employees, contractors, or licensors be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages — including damages for lost profits, lost revenue, lost data, loss of goodwill, business interruption, personal injury, or any other intangible loss — arising from or related to your use of or inability to use the Site, even if we have been advised of the possibility of such damages.
In no event will our aggregate liability for any and all claims arising from or related to the Site, whether in contract, tort (including negligence), warranty, strict liability, or any other legal theory, exceed the greater of (a) one hundred US dollars (US$100) or (b) the amount you paid us (if any) in the twelve months preceding the event giving rise to the claim. The Site is provided free of charge, so this cap reflects the basis of the bargain between us.
These limitations apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless nontoxicnook and its operators, officers, employees, contractors, agents, and licensors from and against any and all claims, demands, suits, proceedings, liabilities, losses, damages, judgments, fines, and expenses (including reasonable attorneys' fees and costs) arising from or related to: (a) your use of or inability to use the Site; (b) your violation of these Terms or any applicable law; (c) your violation of any third-party right, including any intellectual-property or privacy right; or (d) any content you submit to the Site. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with our defense.
11. Third-party content and links
The Site links to third-party brand and retailer pages, articles, scientific publications, regulatory filings, and other external resources. We do not control and are not responsible for third-party content, products, services, terms, privacy practices, or availability. Inclusion of a link is not an endorsement of the destination site or its operator. Your dealings with any third party — including merchants reached through affiliate links — are solely between you and that third party.
12. DMCA / copyright complaints
We respect the intellectual-property rights of others and expect users to do the same. If you believe content on the Site infringes your copyright, send a notice that complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) to hello@nontoxicnook.com including:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing, with enough detail (such as a URL) for us to locate it.
- Your contact information (address, phone, email).
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
We will respond to valid notices in accordance with the DMCA, including removing or disabling access to allegedly infringing material and notifying the user who posted it where applicable. Repeated infringers will have their accounts terminated.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. To the extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or our content (a "Dispute") will be resolved as follows:
- Informal resolution first. Before filing any formal claim, you agree to contact us at hello@nontoxicnook.com and attempt to resolve the Dispute informally. We will try to do the same. The parties agree to negotiate in good faith for at least 60 days before proceeding.
- Venue. If informal resolution fails, the state and federal courts located in New York County, New York will have exclusive jurisdiction over any Dispute, and you consent to personal jurisdiction in those courts.
- Individual claims only. Disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator or court may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
- Jury trial waiver. To the extent permitted by law, you and nontoxicnook each waive any right to a trial by jury.
- Time limit. Any claim arising out of or related to these Terms or the Site must be filed within one (1) year after the cause of action accrues; otherwise the claim is permanently barred.
If any portion of this Section 13 is found unenforceable, the remaining portions remain in effect.
Nothing in this Section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property, confidentiality, or security.
14. Changes to the Site
We may, at any time and without notice, modify, suspend, discontinue, or restrict access to all or part of the Site. We will not be liable to you or any third party for any such modification, suspension, or discontinuation. Where reasonable, we will provide notice of significant changes through an announcement on the Site or to your account email.
15. Changes to these Terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top and, where appropriate, provide additional notice. Your continued use of the Site after the revised Terms take effect constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Site.
16. Termination
Without limiting any other rights, we may suspend or terminate your access to the Site or your account, with or without notice, at any time, including if we reasonably believe you have violated these Terms, applicable law, or third-party rights, or if continued provision of the Site to you exposes us to legal or operational risk. Upon termination, all licenses granted to you under these Terms cease immediately. Sections 5–10, 13, and 17 survive termination.
17. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, Affiliate Disclosure, and any other policies referenced from the Site, constitute the entire agreement between you and nontoxicnook concerning the Site and supersede all prior or contemporaneous communications and proposals.
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be reformed only to the extent necessary to make it enforceable.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
- No agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and nontoxicnook.
- Notices. We may provide notice to you by email (to the address associated with your account), by posting on the Site, or by any other reasonable means. You may give notice to us at hello@nontoxicnook.com.
- Force majeure. We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural events, civil disturbances, labor actions, governmental orders, network or hosting provider outages, or shortages of materials.
